1. Agreement to these Terms
These Terms and Conditions ("Terms") are a binding agreement between you and Forhu Inc ("Chumme", "we", "us", "our"), a corporation registered in the United States. They govern your use of the Chumme mobile application and related services (the "Service").
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. What Chumme is
Chumme is a social and music app. Depending on the version you use, it lets you:
- create a profile, and join or create communities ("circles") shown on a globe;
- join chat rooms, post content, and message other users;
- record, upload and share audio, and sing or collaborate with others in rooms;
- browse music, sports and discovery features.
Features may change, be added or be removed at any time. Some features may be labelled "coming soon" or "beta" and may be unreliable.
3. Eligibility
- You must be at least 13 years old (or the minimum age of digital consent in your country, if higher) to use the Service.
- If you are under the age of majority where you live, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
- You must not have been previously banned from the Service.
- You must be able to form a binding contract with us.
4. Your account
- You can sign up with email or with Google Sign-In. You must give accurate, current information.
- You are responsible for keeping your login details secure and for all activity under your account. Tell us promptly at aiforhu@gmail.com if you suspect unauthorized access.
- One person, one account. You may not sell, transfer or share your account.
- You can delete your account at any time in Settings → Privacy → Delete account. Deletion is permanent (see Section 10).
5. Acceptable use
You agree not to:
- harass, bully, threaten, stalk, or abuse anyone, or post hate speech or content that promotes violence or discrimination;
- post any sexual content or nudity, including any sexual content involving minors;
- impersonate any person or organization, or misrepresent your affiliation;
- post spam, scams, malware, or unsolicited advertising;
- upload content that infringes someone else's copyright, trademark, privacy or other rights;
- scrape, reverse engineer, decompile, or interfere with the Service or its security, or use bots or automated means to access it without our written consent;
- circumvent blocks, bans, privacy settings, or age restrictions;
- use the Service for anything illegal, or to collect other users' personal data without their consent.
We may investigate violations and remove content, restrict features, suspend, or terminate accounts, and report unlawful activity to authorities.
6. Your content
Ownership. You keep ownership of the content you post, upload or record, including audio recordings, lyrics, photos, posts and messages ("User Content").
License to us. To operate the Service, you grant Chumme a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt, format, transmit, display, and play your User Content in connection with running, promoting and improving the Service. This license ends when you delete the content or your account, except where content has been shared with others and they have kept copies, or where we must retain it by law or in backups for a reasonable period.
7. Music, songs and third-party content
Songs, lyrics, artwork and other music-related material available through the Service may be owned by third parties. You may use them only through the Service's features and for personal, non-commercial purposes. We do not grant you any license to third-party music: only upload, record or perform songs that you own or have permission to use. Uploading or recording songs you do not have the right to use may infringe copyright.
If you believe content on the Service infringes your copyright, contact aiforhu@gmail.com with the details of the work, the location of the material, and your contact information. We will respond in line with applicable law and may terminate repeat infringers.
8. Location, microphone, camera and notifications
The Service may ask for permission to use your location (to place a community you create on the globe), microphone (to record audio), camera and photos (for your profile picture), and to send notifications. You can change these permissions at any time in your device settings, though some features may stop working. How we handle this data is described in the Privacy Policy. The location you choose for a community you create is visible to everyone on the globe.
9. Privacy controls and safety
You can control who can message you, manage discovery preferences, and block or report other accounts in the app. We encourage you to use these tools and to report problematic content or users to aiforhu@gmail.com. We may share information with law enforcement where we believe it is necessary to protect safety or comply with law.
10. Termination and account deletion
- By you: stop using the Service or delete your account in the app at any time.
- By us: we may suspend or terminate your access at any time, with or without notice, if you breach these Terms, create risk or legal exposure for us or others, or if we discontinue the Service.
- Effect: upon termination your right to use the Service ends. Deleting your account signs you out on all devices, deactivates the account, and removes your email address, username and password. Your display name, profile photo and the content you posted (such as posts, comments, chat messages and recordings) are not removed automatically; contact aiforhu@gmail.com to have them deleted. Sections that by their nature should survive termination (including 6 and 11–15) will survive.
11. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not guarantee that the Service will be secure or always available, or that content, matches or recordings will be accurate. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
Sports, weather, and similar data are provided by third parties for information only and may be delayed or inaccurate.
12. Limitation of liability
To the maximum extent permitted by law, Chumme and its owners, directors, employees and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or content, arising from your use of (or inability to use) the Service or from other users' conduct or content. Our total liability for any claim relating to the Service will not exceed the greater of US$100 or the amount you paid us in the 12 months before the claim.
Nothing in these Terms limits liability that cannot be excluded by law, such as for fraud, or death or personal injury caused by negligence, or any consumer rights you have under mandatory local law.
13. Indemnity
You agree to indemnify and hold Chumme harmless from claims, losses, and expenses (including reasonable legal fees) arising from your User Content, your breach of these Terms, or your violation of any law or third-party right.
14. Governing law and disputes
These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law rules. Disputes will be resolved in the state and federal courts located in New York, New York. If you are a consumer, you may also have the right to bring claims in your country of residence under mandatory local law. Please try contacting us at aiforhu@gmail.com first so we can attempt to resolve the issue informally.
15. General
- Changes: we may update these Terms. We will notify you in the app or by email of material changes. Continued use after the effective date means you accept the changes.
- Entire agreement: these Terms and the Privacy Policy are the whole agreement between you and us about the Service.
- Severability: if a provision is unenforceable, the rest remains in effect.
- No waiver: our failure to enforce a right is not a waiver of it.
- Assignment: you may not transfer your rights under these Terms; we may assign ours in connection with a merger, acquisition, or sale of assets.
- Third-party services: the Service relies on third parties (for example Amazon Web Services, Google, Apple, Google Play, Mapbox, OpenWeatherMap, Sentry, Meta and TikTok). Their own terms apply to your use of their services.
- App store terms: if you downloaded the app from Apple or Google, they are not a party to these Terms and have no obligation to provide support for the Service.
